The Tonawanda Seneca Nation is fighting a massive 2.2 million square foot, 500 MW generative AI hyperscale data center proposed by STREAM US Data Centers with financial backing from its corporate parent, the private equity multinational Apollo Global Management.
The monster project would be built next to the Nation at the Western New York Science and Technology Advanced Manufacturing Park (STAMP), a proposed mega-industrial site underwritten by NY state subsidies and facilitated by NY state permits and policy. Click here for more background information.
A data center at STAMP directly threatens the Nation’s way of life, its continued existence on its homelands, and its treaty rights. Moreover, because of the uncertainty of approvals, this proposed data center also represents a massive financial risk for its backers.

PS - If you’re thinking, didn’t Governor Kathy Hochul just sign an Executive Order placing a moratorium on the construction of new data centers? The answer is yes, Hochul did enact an Executive Order - for up to one year only (meaning she can revoke it at any time) and only pertaining to some data centers. The threat remains.

Subject: Apollo’s Proposed Data Center Faces Significant Uncertainty: Withdraw Financial Backing Now
To Whom It May Concern:
In August 2025, Apollo acquired a majority stake in STREAM US Data Centers, including a proposed project located in rural Genesee County, New York.
Given recent developments - including an Executive Order by Governor Kathy Hochul that will likely pause construction of the project for up to a year, the Governor’s promise to ban tax subsidies to large data centers, litigation that challenges the legality of the zoning framework for the proposed project site, the postponement of a planned land sale, and powerful community opposition - the viability of the project is uncertain.
Local residents and the adjacent Tonawanda Seneca Nation, a federally recognized Indigenous Nation, have strenuously opposed this project since it was first proposed. They packed three public hearings, docking more than 15 hours of testimony in opposition. They have been joined in their opposition by allies across the state, who submitted more than 3,500 comments opposing the data center application during a recent public comment period.
Moreover, the Nation has asserted that the data center would violate its treaty protected rights to the free use and enjoyment of its Territory. A recent letter from the Sierra Club, which joined the Nation in litigating to stop an earlier proposed data center from STREAM, raises serious questions regarding the geotechnical engineering requirements of the project.
Genesee County residents demand that the local economic development entity, which is currently attempting to bring the STREAM + Apollo project to the County, go back to the drawing board with residents to collectively envision a new path for economic development in the region - one that supports the buildout of amenities, services, and infrastructure that meet peoples’ actual needs while providing protection from undue ecological and economic risk and harm.
No approvals have yet been granted to this project: it is far from a done deal. The opposition movement locally and across the region and the state continues to grow more powerful.
I demand that Apollo Global Management withdraw financial backing from the STREAM US Data Center project proposed for the STAMP mega industrial site in Alabama, NY for the following reasons:

The project represents a significant financial risk given the state’s data center moratorium, pending litigation over zoning, the uncertain nature of approvals and permits for the project, and unresolved fundamental questions concerning the geoengineering required for construction;

The project faces overwhelming local, regional, and statewide public opposition;

The project would violate the treaty-protected rights of the sovereign, federally recognized Tonawanda Seneca Nation.
Apollo continues to pursue the development of the STREAM data center amidst the economic uncertainty of the data center buildout and local opposition. Investors should ask Apollo to address how pursuing the STREAM data center is prudent to their fiduciary duty.
